Respected Members,

Very urgent !!! i need your valuable opinion ,, plssssssss !!!!

My client is a salaried employee of Eastern Railway Department as well as a commission agent of LICI .
During f.y 2012-13, he actually earned as Net salary of rs 3,56,242/= (approx & as per form 16 ) & received as commission of rs 3,92,570/=( as per form 16A ) .
Now, at this point of time his 3 requirements are ,
i) he wants to take a loan against Property ( of rs 15,00,000/= ) from a Nationalized Bank .
ii) he wants to get full amount of refund ( i.e, Rs 39,257/= ).
iii) he doesn't wants to pay any Self-assessment tax.

And I have to fulfill all  the 3 requirements of my client at any cost.

That's why ..
the problems  are ..
1) If i show only Salary Income --> then, there is no question of refund.
2) If i show only Commission Income --> there is no probability of loan sanction of  Rs 15 lacs ( as far as EMI is concern ).
3) If i show both the salary & commission income --> then, bcoz of upper slab rate , client's have to pay Self assessment tax .

What should i do ????????????

Please response..
Thanks

Doob maro.think like professional before committing

if you really are a practicing CA, then my friend, please pay full taxes.

Show salary as advance against salary and for commission get deductions under chp-6a
Behave like professionals dont do any stupid things. Go as per provisions n pay required taxes

You have not mentioned about deductions u/s 80C. You may use this section to reduce tax liability. Not disclosing correct income could get the assessee in trouble. I suppose there is some deduction available specially for commission from insurance. You may use that.

You want to make impossible thing possible...which is not possible..
Pay regular tax...and relax
CA, CWA ho ke aisi baaten?

Respected members,

Thanks for ur reply, my duty is to protect my clients at any cost through tax planning.

one thing i must say that, for f.y 2011-2012 & 2012-2013 , in one case where assessee's income consists of commission & salary & return filed through online by showing only commission income & susequently i got that refund of TDS deducted from commission .

That's why i m asking over here ..

Thanks & need ur valuable reply ..

no. your duty is to give the right advice.  There is no concept called "client is good at any cost".  Please dont talk stupid things.

If a wrong thing has been done in past, that doesn't mean you have to repeat it.

I also want to ask just as chandrakantlabana
Sir if u will not disclose the income on which tax has been deducted then u can claim refund on such income only by disclosing such income in itr otherwise if u claim refund then intimation us 143(1) will b issued . If u want to go for tax planning for ur clients then u should reduce the tax liability of ur client following the exemptions ,deductions, allowances & latest juduciary pronuncements . Full disclosure of income details of ur client and pay required taxes if any then claim deduction us 80c of repayment of housing loan and claim deduction upto Rs. 150000 of interest on loan taken for self occupied hp .

can't understand the hullabaloo about here.

but sir you should give full particulars itr
