Hi,

Can onyone help me in this regard :

We are going to purchase some material from Bangalore party at 4% VAT

Same material will be supplied to a party at hosur, Tamilnadu (Interstate)

Party is not agree to Issue C Form

 So for the above transactions :

       1-    Can i take input VAT 4% on purchase

2-       Can I charge 4% VAT on Interstate Party without C Form

3-       Can I adjust the collection of VAT towards sales to  Interstate  Party with Input VAT 4% and 12.5%

Kindly help me in this regard

Hi, for above question i need some clarity, for that actuallly where are you from..?

If u r from thamilnadu there is on option to u ,or from Karnataka there is another option to u ! so that where r u From?

If u r from bangalore u can take VAT as input credit

without C forn u can not cliame vat as cst so u should take C form from Party if not u can not take input credit

1) Yes. Input tax can be availed.

 

2) If the party is not ready to give Form-C, local rate will be applicable. Hence, you can charge CST at 4% as local rate is 4%.

 

3) Yes.  There is no restriction in KVAT Act with regard to adjustment of input tax 4% from 12.5% and vice versa.  You are eligible to claimed the input tax (whether paid at 4% or 12.5%) from your total tax liability which may consist of CST or VAT at different rates.

dear usha ur question is not so clear but if you are purchasing from same state you can take input but if from other side u cant .. and if you selling goods to other state but they are not providing you c form then u charge the vat rate which is in ur state

another thing we can adjust vat input from our cst liability  and also we can adjust  vat from different rates like output12.5% with input 4%.  hope this solve ur problem

no you cant claim vat input on interstate purchase. and the issuance of c form is compulsory in case of purchase from another state.

dear rav u r wrong  there is not complsory to issue c form for interstate purchase if you dont have c form thn you have to pay full tax from where you buying and not interstate purchse rate..
