Dear Sir,

This is regarding the value of perquisites.

As Fringe benefit tax had been abolished by SC, value of perquisites are being added to gross salary by the employer in order to calculate the income tax liability.

I am working in a PSU, am provided a non-furnished accommodation from my employer for which I am paying license fee and also I have to loose my HRA due to company provided accommodation. I am living in a metro.

My querry is that -" do I need to add 15% of my salary to my gross income in order to calculate my income tax liability ( as the value of perquisites)?"

What I believe is that - " Since I am giving up my HRA ( 30% of basic) and paying license fee for the non-furnished accommodation I have got, it will not be considered as rent free accommodation. Hence 15% amount should Not be added to my salary to calculate the income tax." I don't know my understanding is right or not.

Since you are not a CG/SG employee (instead PSU), license fee alone cannot be considered as the value of perquisite. Value of perquisite can, in this case, be 15% of salary less licence fee paid.

Agreed. But in addition to paying license fee, i am also not receiving HRA ( 30%). So in a way I am paying License Fee + HRA as rent. Will this not qualify against the vaulue of Perquisite?

Do you mean to say that HRA is totally removed from your salary structure (means reduction in gross salary) and in addition, license fee is being deducted from the remaining portion or you are paying license fee from the remaining salary? If so, it is a double loss for you. You need to discuss with the employer about the same.

Yes. I do not receive HRA. My gross salary includes Basic pay and DA only. I have to pay License fee from the remaining salary. And on top of this, my employer adds 15% (value of perquisites) of my salary to my gross salary for the calculation of Income Tax. Is it okay? Or do I have to remove this 15% part from my gross salary and claim a TAX REFUND from Income Tax Department?

  1. You can't remove 15% salary because the amount of perquisite taxable in this case (as per provisions of IT Act) is 15% salary LESS license fee paid, whether you receive HRA or not.
  2. It is an internal problem between you and your employer. Hence I suggest that you explain the situation to the employer and ask them to compensate for the same.
