Validity of Back-Dated Rent Agreements for TDS Exemption

In our company, some employees have submitted rent agreements to claim TDS exemption under Section 10(13A) (House Rent Allowance). However, upon scrutiny, we found that some of these agreements appear to be back-dated.

For example, one employee provided a rent agreement on a stamp paper dated 21st December 2024, but the agreement mentions that the rent commenced in April 2024.

My queries are:

  1. Is it legally valid to back-date a rent agreement to a period before the date on the stamp paper?
  2. Can such agreements be considered genuine for income tax purposes?
  3. Are there any specific guidelines or case laws regarding the validity of such back-dated agreements when claiming TDS exemption?

The rent agreement should be registered with Sub-registrar office. If it is registered agrrement, it is valid.

In some states notarized agreements are accepted, but not otherwise.
