I have received TDS certificate from one bank which mentions UTNs for all TDS deductions done. They are using some new Form 16 A but other bank issued TDS Certificate using old Form 16A (ie does not have column to specify UTNs). On enquiring with second bank the manager replied "Now IT department does not insist for either Form 16 or Form 16A from the assessee. It is the document that is useful only for assessees to file their return. As for as IT department is concerned we are filing eTDS where all the details are given electronically, through which they reconcile with the one you file. I was given to understand that this year both the forms will hold good." I am confused. Kindly suggest if the claim by this manager true or we must have TDS Certificate with UTN specified.  Thanking you. Best regards, RAKESH

Dear Sir,

TDS certificates (i:e Form 16A) are no longer required to be submitted along with the return. neither in original nor in duplicate.

But the same should be obtained from the deductor for the purposes of filing return of Income and if it so happens that AO wants to see Form 16A then the same can be produced before him.

Hi,

First of all how can bank gave u TDS certificate with UTNs??? UTN system has already been discontinued and now TDS certificates is being issued as per old procedures. You should keep TDS certificate for future reference and ITO can demand the same during IT assessment.

Thanks Mr. Mahendra. So seems this manager who issued the TDS certificates with UTN is unaware of the latest development regarding UTN. But, I guess the TDS Certificates issued by him will be considered valid by IT Department. However, I read on the following Tax Guru website that Form 16A with mention of UTN are valid wef 1-4-2009. Is this an outdated news. Where can I find the latest news & Form 16A? The link for Tax Guru where I found Form 16A with mention of UTN is:

You can refer press release dated 30.06.2009 and latest TDS notification dated 18.02.2010 where UTN system has been cancelled. relevant notification is attached herewith for your reference.

Thanks Mr. Mahendra for sending the doc. I tried to search word UTN in the doc to read the sententence which says that UTN has been cancelled but could not find it. Possibly my mistake (could not search it properly as the doc is too big). Thanking you once again, RAKESH

The Central Board of Direct Taxes have further decided that the Notification No.31 of 2009 dated 25.3.2009 amending or substituting Rules 30, 31, 31A and 31AA of the Income Tax Rules, 1962 shall be kept in abeyance for the time being.Taxpayers filing their income tax returns for assessment year (AY) 2009-10, or
any other earlier AY, may continue to file their returns without mentioning the Unique Transaction Number (UTN) as required under the said Notification. The filing of such returns shall be treated as valid and in compliance to the requirements under section 139 of the Income Tax Act, 1961.


Further, the date from which the Notification No. 31 / 2009 shall become applicable on tax deducted at source (TDS) or tax collected at source (TCS) and
deposited during the current financial year shall be notified by the Central Board of Direct Taxes subsequently.
 

All deductors / collectors of TDS / TCS may continue to deposit their TDS / TCS and file their quarterly TDS / TCS returns as per procedure existing prior to issuance of Notification No.31 / 2009 dated 25.3.2009.
