Urgent query: reverse charge

I am limited comapny and availing services of guard from security FIRM. Now i am liable for paying 75% service tax under reverse charge (manpower supply). Now in case the service provider charges 12.36% service tax in its bill and the same is paid by me, then what are the consequences. Is it possible that i can get notice for not being able to discharge my liability as service receiver even though there is no revenue loss to government.

As a SR you will be requird to pay your portion, if you get Invoice with 12.36% Service Tax you should make payment w.r.t  balance 25% of ask vendor to revise Invoice.

Ask your security agency to revise the invoice and adjust the differential payment. You have to discharge your portion of liability. I agree that there is no revenue loss to the govt....  it can be taken as good argument but its not as per requirement of the law. It will be hard to defend in fornt of revenue authorities during audit.
