My freind has a private ltd company in which he. his father & mother are ordinary directors. They all are drawing remuneration from the company .. whether the company will be liable to pay serivice tax on the remuneration paid to them. Can some one clarifies me on this matter because as per mca website records their designation is Director Only it means that they are ordinary director????

Under which provision TDS is deducted on their remuneration, 192 or 194J?

actually the amount of remuneration paid is 120000 p.yr and it is withdrawn in the name of salary however they have mentioned in their accounts as director remuneration

Service Tax is not leviable

because Sec.65B(44) specifically excludes

  • a provision of service by an employee to the employer in the course of or in relation to his employment

from the definition of "Service"
