unconstitutional ban on transfer

THIS STEP, AS ALREADY KNOWN TO EVERYBODY, NOT TAKEN BY "ANY" STUDENT IN RELISH..........

INSTITUTE SHOULD NOT DAWN SUCH ATTITUDE WHILE MAKING SUCH LAWS AND RULES.........THESE ARE, AT THE FACE OF IT, SEEMS INJUSTICE TO THE CA STUDENTS FRATERNITY............IT IS A VERY IMPORTANT INGREDIENT IN THE CA COURSE AND RESTRICTING IT WOULD BE LIKE PLAYING HAVOC TO THE TRAINIG PART OF THE COURSE WHICH IS MORE IN YR AND KNOWLEDGE............

I TOTALLY ABHORES SUCH RULE AND EXPECT THE INSTIUTE TO scrape THIS RULE AS SOON AS POSSIBLE.....!!!!!!!!!!

just submit an application requesting them to allow you a transfer and state a valid reason (eg. better exposure, etc).

for urgency, you can even talk to inst's head, and have an immediate remedy

u jus hv to be genuine on taking a tfr

THE STRICT CLAUSES IN THE NOTIFICATION DOESN'T LEAVES ROOM FOR THE REASON SUCH AS INCREASING THE PURVIEW OF KNOWLEDGE OR TO ENHANCE KNOWLEDGE IN SOME OTHER SECTOR OR AREA OF CHARTERED ACCOUNTANCY FOR CHANGING THE FIRM...............

THE NOTIFICATION CONTAINS THE PROBLEMS FOR CHANGING THE FIRM, AND NOT THE REASONS.............

i hv plenty of frnds who hv taken a transfer on the basis which i conveyed in previous post.

 okay!...but dat can be d case with the certain conditions you r  talking bout....m talking abt the normal circumstances shrihari.....i don't noe hw ur friends got....

Institute had said that we will have to seek permission even before submitting form 109. (2-3months for this). The decentralised office's staff will say "we don;t have info on this;plz contact bombay or dilli" ; and for tht permission only months will elapse.

Suppose i ask my principal to sign my form 109 after much haggling he will sign and i find new CA for articleship; i leave office and begin working in new office.I submit form 109. And after 3 months;there are high chances that a reply from the ICAI saying form 109 rejected; then what will the article do? Risks are too high.His old CA wont take him back.

Shrihari, plz tell whether your friends are living in headquarters of Regional Ofiice(mumbai,chennai,delhi,lucknow,calcutta); such that they could persuade the officers who process their form 109. Suppose the article lives in other city like Bhilwara in case of Rajasthan; he wont be able to persuade the officer in jaipur/dilli.So risks for him is quite high
