Uber levying 5% gst on toll tax/vehicle entry tax.

Uber India is charging 5% GST on the vehicle entry tax which according to me is illegal. Please refer attachments (Sr. no. 24 from document ‘gst_services_rate.pdf’) . Despite repeated number of conversations over mail/twitter, Uber India continues to charge 5% GST on vehicle entry tax and collect money from consumers. Please note that Ola doesn't charge 5% GST on vehicle entry tax.

My question is:

1) Is above levying of GST correct? If yes, then why Ola is not charging?
