Dear Members

One of my client going to start Charitable and Religous Trust and the object of the Trust are

a) Establishment of Church, Bible school, etc

b) Establishment of school, helping poor, education to poor, prevent achoholism, etc

My doubt is

1. whether registration u/s 12AA of IT Act is possible?

2. whether we can apply for 80G exemption?

Dear Santhos,

 

Be assured that your client can definitely apply for registration under section 12A.  It has to be done within a year of incorporation of the trust. 

 

Registration under 80G is a subsequent procedure and with the proposed objects of the organization, there should not be any problem in 80G registration either.

 

I am personally doing such registration for many clients of mine.  In case your client interested, I shall be glad to be of further help.
 

Both applications can be applied together or it can also be applied separately also. If some organization is willing to apply both applications separately, then application for registration u/s 12A will be applied first. Getting 12A registration is must for applying application for registration
u/s 80G of Income Tax Act.


PROCEDURE FOR REGISTRATION.
 

Step-1: Dully filled-in application will be submitted to the exemption section of the lncome Tax Department.

Step-2: NGO will receive notice for clarifications from Income Tax Department in 2-3 months after applying.

Step-3: Reply of notice will be submitted by the consultant along with all relevant desired documents to the Income Tax Departments.

Step-4: Consultant will personally visit the Income Tax Departments to follow-up the case on behalf of the applicant organization.

Step-5: Exemption Certificates will be issued.

VALIDITY PERIOD

12A registration : Lifetime validity
80G registration : 1 to 3 years validity

 

 

 

Documents reguired for registration u/s 12A AND 80G:

  1. Dully filled in Form - 10A for registration u/s 12A registration;
  2. Dully filled in Form - 10G for registration u/s 80G registration;
  3. Registration Certificate and MOA /Trust Deed (two copies - self attested by NGO head);
  4. NOC from Landlord (where registered office is situated);
  5. Copy of PAN card of NGO;
  6. Electricity Bill / House tax Receipt /Water Bill (photocopy);
  7. Evidence of welfare activities carried out & Progress Report since inception or last 3 years;
  8. Books of Accounts, Balance Sheet & ITR (if any), since inception or last 3years;
  9. List of donors along with their address and PAN;
  10. List of governing body I board of trustees members with their contact details;
  11. Original RC and MOA /Trust Deed for verification;
  12. Authority letter in favor of NGO Factory;
  13. Any other document I affidavit / undertaking I information asked by the Income Tax department

We have registered one trust on 2009-10; where due to no idea of compliances we failed to apply for PAN CARD and account opening in any nationalised bank; where the intention was not wrong we are continuously in organizing of various BLOOD DONATION CAMP and other activities, the only suggestion required from my experts that in this case How I can apply for 12AA, where the 3 years of balancesheet is mandetory; also wanted to know that Can I open an account now and maintain the same?
 
What are the important steps for me now to get registration under 12aa?

I am Pratap Kumar Ankamreddi from Visakhapatnam, Andhra Pradesh.

 

I am planning to start a Trust ( Main Concept : helping poor people for better education, Health and financial support ).

 

As on date i have given No of Bags, books, writing materials to children, sewing machines to poor people , financial support for poor people, etc., But it is lot of burden to me. So, I have planned to start trust.

 

Can you please advise or prepare Trust deed ( with exemption Income tax) on payable basis.

if school is running as a trust. but this trust is not registered with any authority i.e society registration act, they just prepared trust deed and start a school. But The school got exemption from State Government.

Then Whether this trust/School is eligible to apply  Reg 12A and 80G. Kindly explain me indetail.

Hi, Mr. Santosh Kumar, I want to tell you that your friend can register for 12A Certificate of IT Act and he or she can also apply for 80G Certificate as well. One of my friends also did the same and he preferred Tradenfill for this.
