we have entered into a partnership deed as xyz Communication for

being franchisee partner of your esteemed  "THE

ABC STORE". but when we go through obtaining the Sales tax registration

and Trade License, all the authorities asked for displaying the Name board

as XYZ Communication. but we would like to make the Name board as   "THE

ABC STORE" . So please give the right choice how to approach the sales

tax department and other statutory authorities.

For  Sales tax registration the Firm name will be used

i.e. XYZ Communication

franchisee name will not be used for that ........!!!!!!!!!

Can I keep the ABC store as the main board and below it authoried franchise XYZ communication. Because I want to reatin ABC Store as brand. I have got the Licence to use the name from ABC Store Ltd.

No you can use it in your relevant document/Produts only....!!!!!!!!!!!

How come McDonalds, and other franchisee keep their franchisor name board and do business????

You can use "ABC" but not "ABC stores Ltd" as ABC is brand, but abc stores is an establishment.

you are franchise of ABC, and ABC has not opened their branch in your place.

 

just like airtel/vodaphone/idea/BSNL, you can show signboards and advt banners, but ar signboard your company name should displaty at prime place.

XYZ can advertise for ABC Stores on their shop display board subject to permission and payment of tax liablity (if any), but the shop would remain in name of XYZ Ltd, and there is no establishment of ABC in that place except that XYZ is an agency/ sole distributor of ABC

McDonalds has authorized franchise partners, and they  "Display" McDonalds on their board, they dont establish Mcdonalds. 

documents would always be in name of XYZ, its upto XYZ that what he want to display, provided there is no identity confussion for any department, and all tax/ legal responsibilities would go in hands of and catered by XYZ only.

XYZ communication is the authorised franchise of "ABC Store Ltd", and as per agreemetn the Sinage will be "ABC Store". So can I  the Put the Name ABC Store on the name board.

In the Application /Registration Form As XYZ communication authorised presentative of ABC Store Ltd. and Trading in the name of "ABC Store".

you are getting confused between name board and display hording

name board would contain XYZ and nothing

for display board u can use abc/def whatsoever u like, but u have to have proper documents for display of such board.

have close look at McDonald shops, in lower panel the franchise name is written

and they display "McDonalds" only which is brand logo, they dont display the official name of McDonalds

Yes I'm Confused. I'm Talking about the Sinage/name board fixed on the store. So iunderstand is the I can Display in Big Bold "ABC Store" and in the lower panel the xyz communication.

 

Is theri any section which makesuch thing mandatory
