Quick Summary
The Supreme Court has ruled that any amount received from the surrender of tenancy rights is subject to capital gains tax under Section 45 of the Income Tax Act, 1961. If there's no identifiable cost of acquisition for these rights, it's considered zero. Rent paid by a tenant for occupancy does not establish a right in the property, thus the cost of acquisition remains zero.

"Amount received on surrender of tenancy rights is liable to capital gains tax under Section 45 of the Income tax Act, 1961" ..... Honorable Supreme Court...

When there is no cost of acquisition, consider it as ZERO.

Tenant paid rent 250 p m then what is cost of acquisition

Rent paid by tenant was for the stay in the property. It did not create any right in the property. COA remains zero.
