Hello ,

As employers file TDS returns , Can an employee get excess TDS deducted from his account based on TDS returns filed by employer.

or do employee obligated to file ITR to get refund?

The Question is a bit naive, where an employee cant get TDS additionally deducted its not his choice

now if i understand your Question, only by mistake an employees TDS get extra deducted and the remedy for that is to adjust it in the next months payments or else just ask em to claim it under their returns.....

Thanks for the prompt reply.

My question is employer have dedcted excess TDS from an employee account for the f/y 2012-13.

ex: TDS liability on salary of an employee is 5000/- but employer has deducted 7500/- for the f/y 20012-13.

 to get refund of that excess TDS deducted employee has to file ITR.

is this the only option to get refund of TDS ? or employee will get credit of excess TDS automatically into his account through TDS returns filed by employer?

 

 

A EMPLOYEE GET  REFUND OF TDS EXCESS DEDUCTED EVEN IF EMPLOYER FILE RETURN BEHALF OF EMPLOYEE.

EMPLOYER CAN FILE RETURN WITH BEHALF OF EMPLOYEE. 

HERE RETURN MEANS INCOME TAX RETURN

Yes The best way is to ask your employee to claim the excess deduction in his Returns, one more option is that you can adjust the extra deduction in the next month payment but this will lead to confusion,

so what i suggest is the First Option..

Yes, the best way to get TDS refund is that the employee should file Income Tax Return. There are other ways like the employer can revise the TDS return filed for the quarter and adjust the TDS for the next month.
