Tds query on income tax

Sir

My husband expired in MAR 2016. I have filed return of income for the YE 31.03.2016 .He was having FDs which are maturing only in Mar 2018.Interest for these FDs credited and TDS deducted on the same.Can I file his return of income for the YE 31.03.2017 claiming the TDS.

Or I have to add his income with my income and file return.If so can I claim his TDS through my return.

Please guide me

no you are not claiming your husband's TDs
hence you will file separate return of your husband to claim tds
u should inform the bank about his death and transfer all the account to your name

1) first get all  FD and other financial documents on your name by submitting to proper authorities if it is joint.  If on single name and will or nomination present then also it can be transferred.

2) If on single name without will or nomination then obtain a court order for the same in the name of survivors. All survivors (legal heirs) have equal right.

3) You cannot claim TDS on different PAN.  Goto jurisdiction AO and submit death certificate and obtain permission to file return on his behalf.  File his return and obtain refund. Dont delete his bank accounts unless all financial transactions are complete viz dividends on shares, interests on FD, income payout from Mutual funds etc.
