Tds provision for nri - housing property

Hi

I have doubt on TDS provisions NRI

NRI having a property in India, he is selling that property arising long term capital gain.  the purchaser is Resident individual, he is liable to deduct the TDS or Not.  the purchaser is not doing any business.  not having TAN also.

buyer has to deduct tax @ 20% while making payments to NRI.
Buyer shud obtain first TAN by filling form 49B before deduction of tax and deposit the same on or before 7th of next month.

Thanks for reply, incase the NRI seller give rights to Power agent to sell property, the power agent is resident individual in India, same provision is applicable

the buyer is Senior citizen, the above provision is applicable?
