Tds on sale of property by nri builder

Whenever a NRI sells property in India the buiyer should deduct TDS u/s 195. In this case the NRI seller is having construction business and he is selling a shop (Business Income, not capital gain)

Should the TDs be deducted u/s 195 @ 31.2% by buyer? Will the buyer need to take TAN?

What is the residential status of seller (individual/firm) ?

If its NRI Section 194-IA not applicable........ & hence TDS has to be deducted as per sec. 195

Capital gain @ 20% apply plus surcharge and health and education cess.
buyer is required to take tan no if he is buying a property from NRI .Tan no is not required in case the property is purchased resident Indian
