Hey Guys,

Tell me one thing. I am Supposing to Deduct Tax from Salary Income and Employee is certifying that he is having donation u/s 80G i.e. 100% now my question is whether we should consider the same for calculation of Tax. 

Someone told me Donation should not be consider by employer for calculation of Tax although the same should only be claimed by employee while filing his Income Tax Return.

Pls let me know.

Yes agreed with. Claim 80G while filling.

employer should deduction as per normal return file calculation taxable amount and employee required to submit original documents or copy of the same to employer o.w not..
If the employee is submitting receipts or supporting documents which are sufficient for employer to satisfy himself that 80g can be claimed
then in that case tds will be deducted after considering the donation

someone told me the employer can not do the same. Although employee will claim this into his return while filing Return of Income. 

CBDT circulars do not clarify that whether an employer has to consider 80g or not. my point of view is that if 80g is not considered then the employee will be paying higher taxes. for example, if the employee has income 100 rupees and the tax liability is 20% then TDS amount for the year will be 20 rupees. however, if 80 g is considered say he donated 20 rupees, then his income will be 80 rupees and tax liability will be 16 rupees. this is my point of view. please further refer some experts.
