Tds on professional fees query - urgent

Dear All,

I have a query regarding TDS to be deducted on professional fees paid by the company director. Please refer the points below for a clear picture

1. Director of a compnay is not under audit in last year

2. The fees is paid for the companies under liquidation and bank possession .

3. Hence these companies cannot pay the fees from their respective comapnies bank accounts

4. Therefore the Director of the company is making the payment on companies behalf

Please advice whether the director requires to take the TAN no. as an indivudual and deduct TDS on companies bahalf.

Dear Ruchi, as per my opinion, tds is deductible on such payment. As this payment is on behalf of the company by its director, tds is deductible in the name of co and not in the name of director. Tan is not required for director, tan of co is to be used. Thanks
Sir but the company cannot pay the tds as it's under liquidation.... then in such case can the director make the full payment without deducting tds .

Director should make payment after deducting tds. Deposit in the tan of company.
