members respects can we choose not to Pay the penalty levied on late filing of Tds returns by any ruling or citations Pl clarify thanks

you can avoid payment of late filing fees now, but later intt @ 1.5% per month will be charged if late filing fees not paid within due time. i havent heard of any judgement that support non payment of late filing fees though stay has been granted on recovery proceedings from assessee by high court in diff cases.
