Tds deducted in year 2009-10 but refund not claimed till

Hi every body,

Have a great day !

One of my friend has income from insurance commission and company has deducted the TDS in year (2009-10) on his total commission that is Rs. 13650.00. The problem is that he has not file his Incometax Return for A.Y 2010-11 and in this way he has not claimed his refund. so please let me know is there any option through which he can get refund of this TDS deducted in year 2009-10.

I am also having the same problem, One of my clients reported that his TDS on Bank Fixed Deposit Interest has been deducted during the Financial Year: 2010-11 relating to Assessment Year: 2011-12, No return has been filed yet, His Gross Total income is below the Taxable Limit, Can the amount so deducted be claimed as Refund.

you need to file the return so as to claim you refund. as we use the word Claim.

There is no legal way you can claim your refund directly. If refund amount is not substaintial than there is no point in claiming that refund now

IF A ASSESSEE  HAS NOT FILED THE RETURN U/S 139 (1) OR 139 (4) ,THEN HE CANT CLAIM THE REFUND, REGARDING TDS DEDUCTION.

 

TIME LIMIT FOR 139(4) IS ONE YEAR FROM THE END OF RELEVANT ASSESSMENT YEAR.

I Know, without filing of Income TAX return there is no way of claiming Refunds. But the last date for the Belated return has also been expired.

You have to apply to CBDT under section 119 for filing of ITR and refund. Or else if the amount is high you may contact the local AO to issue you a notice under section 142 / 148 so that you can submit a return. But, for this you have grease their palms.
