Tds deducted but not paid and form 16 issue

I have got salary from April-2012 to November-2012..and company has deducted TDS on it...but it has not paid the TDS to government. still 4 months salary(Dec to March 2013) is also pending. They are not ready to issue form 16 also. Now i have changed the company , here they are asking for form 16 and also i need to file returns because its compulsory for visa approval...It would be helpful if some one answer my query of how to proceed in this situation.

Dear Mr. Vivek,

You can use your salary slips to file returns on time since salary slips mention deductions from your salary, one of which is TDS. Hence, non-receipt of form 16 is no more a barrier.

Thanks for the help, but what about the salary from dec to march-2013 which has not been paid still. if i want to file online..where should i fill this component?
