CA Chintan Vyas (Chartered Accountant) 20 March 2012
its require to deposit the same to govt.
Should not do refund..
CA Kiran Sutrave (CA) 20 March 2012
In such a case TDS is not to be refunded because the law specifically requires PAN to be produced on or before making payment to the payee.
If the assessee gives you the PAN then you can revise the Return with the PAN details provided so that the payee can claim the benefit of TDS.
