Taxation in India on returning from a foreign country

I am in Malaysia from 15 Jan 2023 on employment pass. From 1 Apr 2023, my employer has stopped deducting Income Tax in India, since the count of days I am in India for FY 2023-24 is 0 from Apr 1. My salary is being paid in Malaysia in Ringgits, in my Malaysian salary account.

I will go back to India on 15 Sep 2023 at the completion of my assignment. Do I need to pay income tax in India from Sep 2023 for the income earned during Apr - Aug 2023?

Quick Summary
If you've been working abroad and are returning to India, your tax status depends on your total days spent in India during the financial year. Even if your employer stopped Indian tax deductions, you may still owe tax on income earned while abroad if your total stay in India exceeds 182 days, making you a resident Indian. You can also claim a refund for taxes paid in India before your departure by filing a return for the relevant assessment year.

Yes, as your stay in India in FY 2023-24 will be more than 182 days, thereby your status will be Resident Indian.

Thank you! Will I be eligible for any refund for the tax I paid in India from Jan to Mar 2023?

Yes, you have to file return for AY 2023-24 (FY 2022-23).

Any additional taxes paid will be refunded.
