Taxable turnover in maharashtra

As My Client has taken Registration Under MVat

At the time of Registration First bill is of Rs. 2,10,000/- and

Second Sales Bill is of Rs. 2,91,000/- on this above 2 bill Registration under MVAT is Granted but now

the query is that the Sales Tax Officer has told to pay tax on Whole Bill Amount of Rs. 2,91,000/- on which

bill i have taken registration.

My Query is that whether i have to pay tax on Whole Amount of Rs.2,91,000 or

on Over and Above turnover limit of Rs. 5,00,000 please clarify at the earliest way

as the case is pending with STO.

Referring to the provisions of MVAT Act, 2002.

 

Sec. 3(2) says that tax will be payable from the day the limit u/s 3(4) is exceeded.

 

While sec. 3(9) says that tax will be payable immediately from the date of effect of certificate of registration, notwithstanding the fact whether it is voluntary or compulsory.

 

Seems like the STO is correct in his views.
