I have a client who is an NRI.

 

He receives salary from Australia and tax is also deducted there. We have the TDS certificate of Australian Government.

 

My queries are-

 

1.Which form is to be filled with the income tax department if he receives salary from Australia and earns saving bank interest in an Indian Bank Account?

 

2.Will the salary received be exempt? If yes, under which section?

 

3.How can the TDS be claimed? I mean, like we import form 26-AS

 

4.Can two years return be filled together of such NRI?

first you have to check Is there a Unilateral agreement with Australia (I feel there is DTAA between India & Australia). If there is DTAA, then there are 2 methods of computing tax of NRI.

1. I don't have knowledge of this

2. Under exemption method under DTAA, the salary from Australia will be exempt & there is no section

3. TDS can be claimed in return & Indian Govt. will refund the amt. which has been deducted by Australian Govt. & not through 26AS

4. Yes, you can A.Y. 2013-14, A.Y. 2014-15

just file returns showing it has tax free income since nri
