Tax on payment to Freelancers outside India

Please someone clarify the Indian tax rules for the below

When a foreign resident freelancer is performing services for an Indian project while working offshore (Outside India and not visiting or staying in India ) and is paid by another foreign entity (outside India) than what is the tax and TDS rules to be complied by foreign entity which is based outside India ?

Need not deduct TDS as it will be construed that he is providing service to the foreign entity in place outside India. You have to deduct TDS if you are paying to Foreign entity responsible for paying freelancer.
