Tax Audit applicability when there is VAT ???

Hi every one....

there is one problem.... (old provision about applicability of tax audit u/s 44AB I.E. 40 Lac limit)

if gross sales during the year is 39 Lac and

if output VAT is rs. 1.25 Lac 

to TAX AUDIT applicable or not ??????????  

when we consider total gross billing is exceed Rs.40 LAC but as per accounting system we consider vat as a liability so turnover does not exceed Rs. 40 Lac ...

so reply this post ??? 

about tax audit?
