Surrender of registration certificate

Hey all

Any service provider has to surrender his registration immediately to the superintendent of central excise when he ceases to provide taxable service.

Please tell me what are the implications if not surrendered ???

I don't think there is going to be any penalty. You will have to file service tax return periodically but.

I think general penalty will be levied under section 77. But my client has sold that division but not surrendered the excise and registration certificates.

So, how can it file periodical returns ??

You should file the nil returns and then surrender it to the department
Till service tax reg number is subsisting you have to file service tax return. Nil return is to be filed if no activity is carried out.

you have to file NIL return till surrender of registration certificate. I think no any penaly will be there.

As per rule client should surrender the certificate otherwise Nil return has to b submit failure which lead to penalty of amount 5000( i guess) for each half yearly..
