as per income tax amandement Education cess Can not be dedudted On TDs Payment made to resident

If Payment made NRI Then Edu. Cess Deduted

The TDS rate in case of resident U/S 194 I (Rent-For land), 194J(Technical service) and 94H(Comission) is 10% for Financial year 2011-12 (20% in case of not provinding the PAN)

So wrong of right steps is depend on the situation

Moreover no Educaton cess is required to deducted for above section for F.Y 2011-12.
