Specific Duty in Excise

Where is specific duty mentioned in Excise Laws in India? How can we find the rate of specific duty for a product eligible for specific duty? Does Central Govt declare the product liable for specific duty through Amendment / notification / circular / any other means?

Prior to finance Act 2010 the rate of BED { basic Excise duty }was 8% and nil of SED ( Special Excise Duty ).

But as per finance Act 2010 this rate has been increased to 10% an case of BED  and no change in SED....

For Any particular product govt time to time isuue notification for such purpose

I m not asking about SED (Special Excise Duty- Levied on the basis of 2nd schedule of CETA). I m asking for Specific Duty. For eg. CG impose duty on cement, cigrate etc on the basis of weight, length or volume of product irrespective of their price. Hopefully you have read in Valuation Chapter. There are three types of Duty: Ad vvalurem Duty, Specific Duty and Compound Levy Duty.

So please reply my queries in this regard

i know only one item on which specific duty is leviable that is:tarrif rate of cement clincker-rs.450 per tonne.for info. abt specifie duty go through schedules to central excise tarrif act

But where is specific duty is mentioned in the Excise Law? in Act or Rules?

How can govt levy excise duty through Custom Act.

I ve read that cvd is imposed on imported goods if excise duty is levied on such goods  manufactured in India 

 

can No one  help me?

dear niranjan kumar. i have recently joined this forum. while going through the previous querries i saw your query. although this late answer but hopefully i am able to guide you. kindly go through the Central Excise Tariff Act, Customs Tariff Act and Central Excise Act. in the definition portion of all the Acts and preliminary chapters will satisfy your query.  in particular go through section 3 of the Customs Tariff Act and Sections 2,3 & 4 of the Central Excise Act. if not satisfied , still let me know.
