Special additional duty - customs

I am a dealer for an Importer. While my importer raises an invoice, he charges Additional duty of 4% apart from CVD and cess. The invoice also states that Additional duty cannot be claimed back from the Customs Dept.. We use tally for for our invoicing and accordingly we select the appropriate option, that states that Additional duty cannot be claimed back from customs under Sub Section 5 of tariff act.. But my customer (Excise reg manuf) insists on that we pass on the Additional duty, so that he can claim and adjust it with his ED payment..we are Excise Reg dealer and generally pass on the CVD to our customers.. can i pass on the Additional duty ?

This refund will be allowed only if u r selling the imported good after clearance from customs in local market  by paying the applicable VAT and procured the requisite documents with refund application thre ris no doubt in getting the refund fm concern authority.

SAD refund is admissible to original importer only, provided he has sold the goods in local market after paying local vat. 

 

a excise dealer has nothing to do about it.
