23 April 2015Service tax paid under RCM ( @ 50-50 under works contract) on construction of sewage treatment plant. Are eligible to take credit of the same considering it as a part of production ?

ST paid on Works contract is not allowed as credit because the same has been specifically excluded from the definition of input service as defined in Rule 2(l) of Cenvat Credit Rules,2004.
However,credit is allowed if the services are availed by main contrator from sub contractor.
