Service tax reverse charge mechanism
Hi,
We are travel agents and provide various services in relation to tours, travel etc across globe.
Now the Question is we book an hotel on behalf of customer and pay the amount in their respective currency. Do the Service Tax Reverse charge is applicable on renting of hotel rooms abroad, as the service provider is located in non taxable territory.

here you are the service provider, because you will be raising invoice to your client
Normally service provided and recived outside India are not a subject matter of ST. In the HC decision in Orient Craft similar observation was made. That portion should not be liable under RCM for you. However dispute is possible.
