SERVICE TAX RETURNS

For one of my clients, his total service amount is Rs. 3,00,000. He is not liable to collect and pay tax, but he has collected and paid service tax. Now when we are filing the return of service tax, the department is asking to pay penalty. What to do ?

client has to pay penalty if he has delayed in filling return.

this case would be same as the case above exemption limit i.e. 1000000

By collecting service tax you client has decided not to avail small scale exemption.  Ttarget='_blank' rel='nofollow' hrefore, all the requirements of the Act should be followed.

hi there... there is no hard n fast rule that a person should not collect service tax if his receipts are below Rs 8,oo,oooo...But receipts above it are to be compulsarily taxed...the departments claim is wrong.. ask for the rules under which they are askin for penalty...!!!!!!!!1111
