Service Tax on Rent

Can any one Help me that:

We are Paying a Monthly

                  1. Rent of Rs. 1,00,000

                   2.Amenties - Rs.50,000

                  3. Maintance Charges - Rs,50,000

                                                     --------------------------

                                     Total            2,00,000 P.M

                                                    ---------------------------

 

Land Lord Mr.X Asking Service on Amount of Rs. 2,00,000+Service Tax 12.36%

I dont Know, Wheteher Amenties and Maintance Charges were cover under the Service Tax Act.   

Please help me with breif notes and Ammendments

If the Landlord is charging maintenance charges on apportioning the same on all the unit at cost. Can service tax be levied on the same.

we are paying rent Rs.250000/- per month ,deduct TDS-Rent @ 20.60%i.e. Rs.51,500/-  and pay Rs.198500/-.,my question is whether it will attract service tax?

We are paying Security charges  to our owner ,whether we have to pay service tax to our owner?

Dear Mr. Surekha,

Assuming that you are paying rent on premises taken on rent for commercial use, you are liable to pay service tax. Security charges are also covered under service tax.
