Service tax on educational institute

hello sir / madam,

i am working in one educational institute and our institute is constuct a swimming pool in our college area regarding this we are hire one architecture & designing firm and made a contract with them regarding the architectural & designing service receiving from them now the point is raised that the service tax levied by him in the invoice is payable or not is there any rule regarding this that the service tax is not leviable on educational institute because it is not a commercial or profit making organization.

please help me

Architect is liable to pay service tax even on services provided to educational institution.

Thanks for your help sir bur my question is that our institute are liable to service tax to him which he is levied in his invoice or we are not liable to pay that service tax. i mean as an charitable institute should we pay him the gross amount which he charged us including service tax or we should pay him only the net amount excluding the service tax amount the question is are we have to pay service tax or not being as an charitable institute

No such exemption. You have pay gross bill amount including service tax. Also comply TDS.

Thank you very much sir,

now please help me out with the information about which i am confused

in relation to salaried person he get rs-100000 deduction under section 80 c

but when he paid amount for health insurance under section 80 d , donation's under section 80 g

is thease deduction is admmissible in extra i mean 80c's 100000+80d 15000+80g 5000

so the total deduction is rs-120000 or he will get only deduction of rs-100000 including thease all

please explain me the concept

sir i want to ask that if educational institute take service of contractors & security services then educational institute liable to pay service tax?should they have to take service tax no?or then just have to pay amount including service tax to service provider?

sir can you tell me ragrding this?
