Service Tax on Ayurvedic Massage Treatments

We are running an Ayurvedic Panchakarma treatment centre. The visitor will first consult the Doctor and the Doctor will prescribe what massage treatments are to be undergone. We are at present marketing this as a Panchakarma treatment centre. Are we exempt from Service Tax? Do we have to register ourselves for Service Tax? If we start marketing the centre as a Health Spa, will it make any difference? I hope someone will be able to clarify.

There is a taxable service - health and fitness clinic and you may have to examine whether the same is appropriate. Thereupatic treatment cannot be covered under that catgeory.

However when you market as a spa then the dept may seek to examine your contention that the same is a thereupatic treatment and may also seek information from the customers.

It a grey area and it is a debatable issue.

It can be considered as an exempt service because it can be considered as a Aurvedic Treatment Service and it can be considered as a Health Service.

When a massage provided by qualified professionals under medical supervision for curing diseases such as arthritis, chronic low back pain and sciatica etc. Ayurvedic massage, acupressure therapy etc. given by qualified professionals under medical supervision for curing diseases/disorders will come under the category of therapeutic massages and such can be considered as a Health Care Services so it can be exempt service
