But he will have to file nil returns till he surrender his ST Registration.

If the turnover exceeds Rs. 10 Lacs definitely service tax is applicable.

Further, you have mentioned that you have obtained service tax number. At the time of applying for service tax number you are giving a declaration that you will be paying service tax even if turnover is below taxable limit.

So in any case, you have to pay service tax and file service tax return.

In case, you have not done it before you can apply and pay under amnesty scheme.

 

 

According to N/N 33/2012 dated 20-6-2012, if the aggregate value of taxable service during the preceding FY was not exceeding Rs. 10 Lacs, then no need to pay service tax on taxable service up to Rs. 10 Lacs. Otherwise, Pay service tax from Re. 1 onwards.

Yes I agree with the above there is no liability to pay service tax if you turnover does not exceeds Rs. 10 Lakh but also raised your liability raised have to submitted the Service-Tax Return on quarterly and half yearly basis and also correspondence with the concern department.

Is it necessary to apply for service tax number ? I do have turnover more than 10 lakhs but I dont take any service tax from my vendor / clients. Still do i have to apply for Service tax number ? 

Now a days banks made it mandatory to apply for service tax number before opening a current account. But at that time it was not mandatory and i have a current account with my business name but that is just for clients to deposit payments coz they dont trust to deposit in personal account.

When you are provided the taxable service or agree to be provided the taxable service in taxable territory and also you have crossed the exemption limit Rs. 10 Lakh then you have to mandatory for Service Tax Registration.

Further, In this regard you can operate the business with Current or S.B. account. There is no doubt.
