One of my client enrolled for service tax in August 2016 on advice of Banker. He has not file any return of service tax and also not charge any service tax on his service. The total of his service receipt is Rs 8,57,000.00. So my question is that is he is require to pay service tax amount considering receipt amount as inclusive of service tax or he is not require to pay any tax.

Yes, Filing of return within the prescribed time limit is compulsory, even if it may be a nil return, failing which penal action is attracted.
NIL return can be filied by claiming exemption vide N/N-33/2012 dated 20-06-12 in the appropriate column and the taxable amount shall become zero.

NIL Service Tax return has to be filed. if it is envisaged that the future service income will not exceed Rs 10 Lakhs ,surrendwring the service tax registration may be thoughtoff

 

 

Not required file service tax return.

A person who is not liable to pay service tax because of the availment of exemption (SSP) under Notification No 6/2005-ST dated  01.03.2005 (now Notification No.33/2012-ST, dated 20.06.2012 ) is also not required to file Service tax return.
