i have filed ITR for assessment year 2007-08 on 26.04.2007 and notice U\s 143(2) served on 23.07.2008. i took notice of amendment w.e.f. 01.04.2008 in section 143(2) whereas notice can be served up to 30.09.2008.
my querry is that whether amendment shall be applicable for ITRs filed after 01.04.2008 or notice served after 01.04.2008 whether it belongs to earlier assessment year ? Thanks!
Yes, I thk the served notice is correct. As the section 143(2) is a procedural section, thus applies when it is used.

The notice served is perfectly correct.Because in memorandum explaining the finance bill it is clearly written that this amendment shall take place from 01-04-2008 and therefore Income tax department has got power from 01/o4/08 to issue notices within 6 months from the end of financial year in which return was furnished and therefore for all returns filed in 2007-08 notice can be served upto 30.09.08.
