Hi Experts,

I worked for a company from Jan2013 to June 2013. I got the form 16 for AY 2013-14 and have filed ITR for AY 2013-14. But after that i didnt work for one year. And started working on June 2014. I have filed ITR for 2015-16.

But today i got email from incoem tax department about Compliance of Non-filers Monitoring System (NMS) for AY 2014-15.

I dont have form 16 for AY 2014-2015 and my income was alo not taxable. what should i do. How can i fill return for the year with the form 16?

If i fill the compliance form indicating the income was not taxable, will that be sufficient or i need to still need to file the ITR. Please guide.

You can file compliance that your taxable inocme is below the taxabale limits.Practically, if you want to go for any loans in future, you may required to submit your IT returns to the lender. Consider this aspect also. You may declare any income upto the minimum taxable income.

You can file return for AY2014-15.   Take sal for three months April 2013 to june2013. You should take tax credits if 26AS shows this. You can obtain refunds by consuming all tax credits if any. 

just remember that now you have to file return even if your taxable income is below permissible limit.

So I will file the compliance that the income was not taxble. And I would also file the ITR for AY 2014-15(should i do both or one) but, since i dont have the form-16 for that year..and i did not receive paylslips, i used to get check, i know lumsum amount which i got for 3 months.. so just wanted to make sure that this will not impact.. and without form 16 if i file the returm the variance of some 10-15 Rs would not effect anywhere?

Although i would try to get details from the bank statements also as much as possible.

Please confirm this so i could go ahead confidently.

Goto to efiling and see your 26AS tax credits before filing return.  There gross amt given as salary will be there if your employer has deducted tax at source. if there is tax credit then file return. If the tax credit is nil then reply that you were un-employed for 9 months of year.

thogh there is no Form 16, decalre the income as you received it. As suggested by Mr Shiroor, check Form 26 AS also. If you have bank interest , show it under Income from Other Sources... File reply to compliance and also file ITR even below the limit. No worry. As soon as you file compliance, the prompt will go next time..
