No Availment of ITC for Composition dealers.

If you are not under composition then you can take ITC if furtherance of business is satisfied.

No the Restaurant Service provider , even though he Regular Dealer he cannot Claim ITC

we charge 5% from customer without composition can we avail itc

Hey, 5% itself is stating that you have availed concession in tax rates. You cannot avail ITC.

As per Notification 46/2017 CT (RATE) : RATE FOR RESTURANT HAVE BEEN PRECRIBED 5% WITHOUT ITC.

HENCE CANNOT CLAIM ITC
