Dear divyansh your owner should charge service tax from you in his invoice and you have to pay same to him. After that it is the liablity of the owner to deposit the same to government and file his service tax return.

If your landlord is not levying service tax on the rent, you needn't worry. The liability of the same will fall on the landlord and the rent you paid will be considered inclusive of service tax.

As per the service tax rules, the owner should collect the service tax from the tenant and deposit the same to the government. However, he cannot ask you to pay the service tax of the previous months.
