Relief u/s 89

A senior executive got retired from government department  and started working in  a company. In f.y. 2007-08 his status was of NRI and taxable income was around Rs. 1.9 lacs only. Now, in the current f.y. he received his pension arrears from his govt. depart. on account of 6th pay commission. Can he claim relief u/s 89, in respect of arrears of pension, related to f.y. 2007-08 amounting to Rs. 2.5 lacs, in current f.y. i.e. 2009-10 ?

Dear Pankaj Sir,

As long as the amount received is arrears of previous FY & is taxable under head salary the relief u/s 89(1) will be available execpt in case of VRS
