In our company one of the employee's salary income will be 325000/- (FY.2013-14) but there is no tax liability due to home loan and other deductions. if there is no TDS how a company can issue Form 16 to the employee? Whether TDS is a must for generation of Form 16? What to do if salary income in greater than 200000/- during the year? Is it necessary to upload the details in TDS return? Thanks in advance.

All the detail is required to file in TDS return.

Form 16 will contain the details about the income and deductions availed by the employee. It is must even if no TDS is there.

Take the necessary document from teh employee like the home loans and other deductions and then check if his income is taxable, if not then no TDS which means no need to deduct TDS

if there is no income available for tax, then no need to upload TDS return.
