Refund of capital goods

i have applied for refund of ITC and i got 90% provisional refund but the remaining 10% amount has been rejected the officers says that itc on capital goods can't be claimed as refund. I have not claimed depriciation on the capital goods.i referred all the sections and rules but there is no such statement.
