Dear Sir ,

I would like to ask you following Questions :

(1) I have Paid Advance Tax on 15th December 2010 which is more than TDS to be deducted by my Employer. . I asked my employer not to deduct TDS from my salary.But now head of my Tax Department is saying that Company has defaulted in Deducting TDS from my Salary. My Question is Whether company has defaulted ?

(2) My Decision was based on the Information I had in case of CIT V/s Mahindra and Mahindra Ltd. I am searching on the website but I am not finding that case. My Question is can you please provide me ITR No. and details of the case.

TDS is part of employer, and they have to deduct on salary.

advance tax paid by you, is for some other purpose/ income/ capital gain, and you dont have to calculate salary component while paying advance tax.

if company had not deducted tds from salary, then surely they are defaulters in TDS return,

have you reported the advance tax in your form 12B? as there is no space in form 16 for advance tax.

It is companies responsibility to deduct TDS from salary and pay to the Government Account

my question is this how much pf we deduct on basic salary and is the company is also liable to give same percentage to the employee ?
and how much reimbursement we can show of conv.charges and medical and daily allowances?
please help me for the same.
