Respected Sirs and Madams,

I am working in a private organisation. The previous employee had deposited 2010-11 April TDS.and left the job.recently I joined the company. While Calculating TDS on Salaries our senior told that TDS had not paid through challn. I had Calculated TDS amount for the whole year 2010-11. and deposited the same into bank and issued form 16 to employees.later came to know that april month 2010 TDS amount paid through challan return not submitted. Here we have paid april month TDS twice. Can I claim the  excess amount of TDS paid.If we can claim, what is the procedure and to whom we contact .Please give me solution. Here we are filing returns online, not manually.

Thanking you,

Venkat

I think you can claim the Excess of TDS amount. It is recommended please contact your Area Assessing officer.

you can claim this amount you have need to meet loacl assessing officer with a authority letter and challann copy of those payament and present your side to depatment

(i) You will get the refund / adjust against tax liability by contacting your assessing officer.

(ii) You may revise your TDS return and show both the challan and the amount excess deducted  shown under a "Known Employee PAN " and  file his return online and get the refund.
