Quarterly tds return

Hello, should a person must be file his quarterly tds return even if he had not neither deducted tds nor deposited it from any person's payment?

Not required to file e-tds as there were no entries as per requirement.However NSDL ask u to file return i think.

If You have TAN, then you have to file TDS return.

If there is no entry in the quarter then a NIL return is to be submitted. Same is the case of Service Tax Also.

what is penalty on non filling of Nil TDS/ TCS return.

You have to file NIL Tax return. This has a reason that it conveys a message(Information) to the tax authorities that you had not any taxable transaction during the period.

U/s 272A(2) of Income Tax Act, Penalty of Rs.100 for every day during which failure continues, provided that the amount  of penalty shall not exceed by the amount of tax deductible or collectable, as the case may be. so is it applicable on Nil return or not?

if u did not deducted TDS in a Quarter then u donot need to file a return for it :)

 Filing of nil return is necessary in case of VAT &  Service Tax but not in case of TDS....

so for nil TDS return - no Filing & obviously no penalty !!
