Promoter, builder and developers

started construction of commercial mall where some shops can be sold and some let out by builder after construction, but from starting to end of construction various material, input services, etc received by builder in which gst charged by supplier to builder, my question is can builder take itc of material, services??

Yes can take a ITC
To the extent of sale of shops, claim and use ITC. To the extent of let out property case is pending in s c. hence claim ITC but don't utilise it. let it remain as it is. so if in future, if case is in favour of builder then u will be able to utilise at that time. lullakishor @ gmail.com
